The State of Alabama
Tallapoosa County

I, SOLOMON LACKS, being of sound and disposing mind and memory, but feeble in body, do make and constitute this my last will and testament hereby revoking all others heretofore made by me.

Item the 1st.
I will that all my just debts be paid by my executors.

Item the 2nd.
I will and bequeath all of my lands in Tallapoosa County and known as the East half of the South West quarter of Section Twenty four in Township Twenty two of Range twenty two, and the South West quarter of the South West quarter of Section thirteen in the same township and Range to my Brothers and the heirs of their bodies, viz. WILLIAM LACKS, BENJAMIN LACKS and JOHN LACKS of Halifax County in the State of Virginia, also my sorrel mare, all of my stock of hogs, my Kitchen furniture, and two chairs and one table.

Item 3rd.
I will and bequeath my claybank mare colt and all of my farming utensils to JAMES RAY.

Item 4th.
I will and bequeath to my beloved wife JANE LACKS two cows and two yearlings, and all of my household furniture not heretofore disposed of to my three Brothers.

Item the 5th.
I hereby constitute and appoint WILLIAM C. GRISHAM and JAMES RAY my executors to carry out the provisions of this my last will and testament, and it is my desire that my said Executors pay whatever debts I may be owing at the time of my death out of the crop that may be growing at the time, or on hand.

Signed, Sealed, Published and Declared in our presence this 11th day of May A. D. 1852.

Personally came into open court on this the 14th day of February A. D. 1853. LUKE DAVENPORT and CHURCHWELL CORPRENS (?) who being first duly sworn, on oath says that they as subscribing witnesses, attested the signing, sealing and publishing that it bears the date thereof and that the same was signed in their presence by the said SOLOMON LACKS the said testor after the same had been read over to him, and that SIMON GOOLSBY whose name also appears as a subscribing witness thereto, also signed and witnessed the same in the presence of each of us, and that in our opinion the said testor, the said SOLOMON LACKS was of sound and disposing mind and memory at the time of making, signing and publishing the said will, and that the same was done by him of his own free will, without any undue influence.

Sworn to and subscribed in open Court on this the 14th day of Feby 1853.
